1. Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of the website, mobile application, and related services provided by Orivum Identity, S.L. (the "Service"). By using the Service, you agree to these Terms.

If you do not agree to these Terms, do not use the Service.

2. Eligibility

You must be at least 18 and legally able to enter into a binding agreement to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

3. Accounts

You may need to create an account to use some features of the Service. You are responsible for:

  • Providing accurate information
  • Maintaining the confidentiality of your login credentials
  • All activities that occur under your account

You must notify us promptly if you believe your account has been compromised.

4. Google Sign-In and third-party services

The Service may allow you to sign in using Google or other third-party services. Your use of those services is subject to their own terms and privacy policies.

We are not responsible for third-party services.

5. Permitted use

You agree to use the Service only in compliance with applicable law and these Terms.

You must not:

  • Use the Service for unlawful, fraudulent, or misleading purposes
  • Interfere with the operation or security of the Service
  • Attempt unauthorized access to systems or data
  • Reverse engineer, scrape, or exploit the Service except as permitted by law
  • Upload or transmit malicious code
  • Infringe intellectual property or privacy rights of others

6. User content

If you submit, upload, or share content through the Service ("User Content"), you retain ownership of your User Content.

You grant us a non-exclusive, worldwide, royalty-free license to host, use, reproduce, process, and display User Content only as necessary to operate, provide, and improve the Service.

You represent that you have the rights necessary to provide the User Content and that it does not violate the law or the rights of others.

7. Intellectual property

The Service, including its software, design, branding, text, graphics, and other content, is owned by Orivum Identity, S.L. or its licensors and is protected by applicable intellectual property laws.

Except as expressly permitted in these Terms, no rights are granted to you.

8. Privacy

Our collection and use of personal data is described in our Privacy Policy.

9. Service availability and changes

We may modify, suspend, or discontinue all or part of the Service at any time, with or without notice.

We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free.

10. Termination

We may suspend or terminate your access to the Service if you violate these Terms, create risk or legal exposure for us, or where otherwise reasonably necessary.

You may stop using the Service at any time.

Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, and dispute-related provisions.

11. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

12. Limitation of liability

To the maximum extent permitted by law, Orivum Identity, S.L. and its directors, employees, affiliates, agents, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, goodwill, or business opportunities.

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service or these Terms will not exceed the greater of: (a) the amount you paid us for the Service in the twelve months before the event giving rise to the claim, or (b) EUR 100.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law.

13. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Orivum Identity, S.L. and its affiliates, officers, employees, and agents from claims, damages, liabilities, and expenses arising out of your use of the Service, your User Content, or your violation of these Terms.

14. Governing law and jurisdiction

These Terms are governed by the laws of Spain, excluding conflict of law rules.

The courts of Madrid, Spain will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service, unless applicable consumer law provides otherwise.

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms and revise the "Last updated" date.
